Carer Terms & Conditions
This Carer Terms shall apply to any individual using our Service or our Platform as a Carer.
Please note that by registering with the Grand24 platform you automatically agree to the Terms and Conditions as stated below. Please read these Terms carefully. These terms are a legally binding contract between you and us. If you refuse to accept these Terms, you should not complete the registration process and should immediately cease to access and/or use our website www.grand24.co.uk in any manner.
We reserve the right to change these terms and conditions at any time by posting changes online. Your continued use of the site after changes are posted constitutes your acceptance to any modifications.
Definitions:
“Agency”, “Grand24” means Grand24 Care Limited, a private limited company registered in England and Wales. with company registration number 11582557.
“Carer, “Caregiver” “Temporary Worker” means individuals working on a self-employed basis, the person introduced by Grand24 to the Client on a temporary or a permanent basis, whether full or part-time.
“Care Seekers”, “customers”, “clients” means individuals to whom the carer is introduced by Grand24 and for whom the care services are provided and enter into a contractual relationship with carers. “Introduction” means the introduction of the Caregiver to the Care seeker by Grand24.
“Account holder” means individuals using the Grnd24 platform to search for home care, engage with carer clients and enter into a service agreement with carers. The account holder and the care seeker can be the same person.
1.Introductory Agency Service
- Grand24 is classified as an ‘introductory agency’ in line with CQC guidance and this agreement does not give rise to a contract of employment between Grand24 and the Carer.
- Gran24 does not directly employ carers and does not provide or arrange for domiciliary care services. We are neither an employment agency or care agency, neither do we directly supply Caregivers to Care Seekers.
- Grand24 is not permitted to make changes to the care plan, provide rotas or have any control over the delivery of care.
- Grand24 does not involve itself in the terms of the contract between care seekers and carers or regulation of their engagement with each other. The service agreement created by the carer at the start of an assignment and accepted by the care seeker/account holder is a legal contract between each of these parties.
- The carer solely decides whether to accept an offer from an account holder to provide the home care service and The care seeker/account holder solely decides whether to accept the carer’s home care service.
- Grand24 is not liable for any loss, controversy, injury, accident, claim, cost, damage, charge, expense, action, or demand whatsoever in any jurisdiction arising from or in any way connected with the Introduction and/or the provision of the care services by the carers.
2.Use of Our Service
By registering by directly or using our website as a carer you confirm that:
- You understand, accept and will abide by all the terms and conditions;
- You are 18 years old or over and have the right to form legally binding contracts under the UK law;
- You are legally capable of entering into binding contracts;
- Any information you provide is correct and accurate including details on your qualifications, skills and experience;
- You will be working on a self-employed basis and will fulfill all the responsibilities and the duties of a self-employed worker including paying all tax and National Insurance due to HMRC;
- You will not receive Holiday pay from Grand24 when working on a self-employed basis;
- All the tools provided by the Grand24 platform are used at the care seekers and self-employed carers’ own risk and there is no guarantee that this work constantly, not be subject to downtime, or removed from service at any point in time due to work being carried out on the site. Grand24 does not accept any liability for losses or damages caused by the temporary unavailability of the service or technical errors. Grand24 has no control over this process.
- You understand that behave in a manner professional and with honesty and integrity;
- You will provide any care per terms agreed with Care Seekers, using your reasonable care and skill by all relevant regulations and requirements;
- You will keep information about other Registered Users confidential;
- You understand that you must not discriminate against a Caregiver or Care Seeker based on colour, age, gender, nationality, disability, sexual orientation, marital status or any other potential source of discrimination;
- You understand that we reserve the right to suspend or terminate your account indefinitely for any reason without notice or liability to you;
- You understand that you are responsible for your own personal safety and should take all necessary precautions when providing the care service to the care seeker;
- Where registering on behalf of someone else you confirm that you are authorised to do so and confirm that the information provided is true and accurate to the best of your knowledge and belief;
- You agree that any Registration Data/Personal Data will be shared with Care Seekers where matches are made to allow Care Seekers to make a decision prior to any booking. We shall not, except in accordance with our terms and conditions, disclose confidential sensitive information about you to other Registered Users or third parties without your consent.
3.Carer Obligations
3.1 You accept that on your behalf, to assist care seekers, we may carry out the vetting and background checks on you. You give permission to use the information you provide to undertake these checks. This includes, but is not limited to, your identity, enhanced DBS certificate, and information made available via the DBS update service.
3.2 You will provide accurate Registration Data and other information and keep the information you provide on the Platform up to date at all times including, in particular, your profile information and your availability to provide care.
3.3 You will provide us any references and vetting information which we may require, and you recognise that you will not become a Registered User until all checks have been satisfactorily completed by us. You further recognise that we may in our absolute discretion decline to register you if you fail our vetting checks, any stage of our application process, or for any other reason.
3.4 You also warrant that you have not been subjected to a restraining order or any other civil action.
3.5 You will monitor your account regularly and will respond promptly to any contact from us or from Care Providers.
3.6 You will NOT provide medical care or medical advice to any Care User.
3.7 You confirm you will keep passwords safe and secure and not allow anyone else to access your account.
4. Live-in Care Requirements
4.1 Live-in carers have various rights pursuant to the law which includes (without limitation):
a. Sanitary living conditions which include (i) a separate bedroom ad suitable bathing and toilet facilities (ii) clean bedding and (iii) provision of ample food. We recommend a minimum of 30 a week for the cost of the carer’s food.
4.2 Live-in Carers require a minimum of 2 hours break per day. The minimum provision must be 14 hours over a 7 day week. If agreed between the Care Seeker and the Carer, these hours may be banked to provide longer periods of time off on fewer days. Carers must not seek to charge for missed breaks, If you try to charge for missed breaks, we may remove you from the contract and our platform altogether.
5.Communications
5.1 You agree that email and SMS will be the official means of communication with the Grand24 service. We may occasionally use other messaging services such as WhatsApp.
6.Insurance Cover
6.1 The carer will maintain active public liability insurance and make access to this policy and means of verification by the care seeker or by us available within 2 hours of our written or verbal request.
6.2 For the avoidance of doubt, any service or any transaction or any other damages whatsoever between the carer and the caregiver that occurs is not covered by the Grand24 insurance policy.
7. Payments, Commission, Holiday, Absences, Cancellations and Refunds
7.1 Payments
All payments for services provided by Carers to Care Seekers must be made via Grand24 using the payment provider stated by us (with the exception of incidental expenses). Privately funded account holders pay one week in advance whilst Local Authority (LA) or CCG funded care seekers pay weekly on completion of the weeks’ care contract. In both instances, the carer receives funds on the next Friday and where appropriate, weekly thereafter.
Any attempt by a Care Seeker to make any payment off Platform, or by a Carer to accept or solicit payment off Platform, entitles Grand24 to immediately suspend the account of the relevant Care Seeker or Carer. Any offer to pay outside of the Platform made by either a Care Seeker or Carer must be reported to Grand24 immediately.
Carer agrees and undertakes not to be paid by the care seeker by any other means and fully indemnify Grand24 on demand against all losses Grand24 incurs or suffers arising as a result of or in connection with Carer’s breach of this Section 6.1.
7.2 Rates and Commission
Carer rates are set by the carer and contractually agreed by the care seeker. The rates should not be changed during a contract agreement. If hourly rates are amended before the end of a contract this must result in the termination of the current contract and a new contract be agreed.
When setting your rate on the platform, the carer should account for Grand24 charges a service fee of 12.5% which is deducted from your hourly rate. Grand24 reserves the right to alter the terms of its commission structure at any time.
7.3 VAT
Grand24 does not charge VAT on the service provided by Carers.
7.4 Holiday and Absences
Grand24 discourages absences from any care seeker appointments. Where the absence is unavoidable, you must inform the care seeker immediately with as much notice as possible. When cancelling any agreed hours with a care seeker, we ask you to notify Grand24 of your cancellation at the same time so that we can assist in finding a replacement.
If you fail to inform the care seeker of any absences or changes in contracted hours and this results in a complaint from the care seeker, we reserve the right to withhold your pay for the week where the unexcused absence occurred.
In cases of any planned holiday or leave, you must inform the care seeker, of your wish to arrange cover at least two weeks in advance of such absence and make best efforts to arrange cover with other self-employed carers registered on Grand24. Any cover with a Grand24 carer must be agreed with the client beforehand and a separate contract must be set up for this period.
7.5 Cancellations
The Grand24 discourages cancellations but where an absence is unavoidable, you must inform your client immediately with as much notice as possible. When cancelling any agreed hours with a client, we ask you to notify us of your cancellation at the same time so that we can assist in finding a replacement.
If you fail to inform your client of any absences or changes in contracted hours and this results in a complaint from the client, we reserve the right to withhold your pay for the week where the unexcused absence occurred.
In cases of planned holiday or leave, you must inform the client of your wish to arrange cover at least 2 weeks in advance of such absence, and make best efforts to arrange cover with other carers registered on our platform. Any cover with the carers must be agreed with the client beforehand and be registered through the Grand24 platform as they would when accepting any other booking.
All cancellations must be submitted by email to both Grand24 and the care seeker.
7.6 Ending a contract Prematurely
If you have agreed to an ongoing contract with a client, you must honour the terms of this contract and ensure that all efforts are made to fulfill the contract through to its conclusion. Where the circumstance is unavoidable, you may decide to end the contract due to other commitments outside of the platform, Grand24 will not permit you to take a new contract on the platform unless sufficient notice has been served. This is to protect the existing client and to ensure continuity of care. If you decide to end a contract with a client, you must provide 14 days notice to the client and Grand24 so that a suitable replacement can be found. If you fail to provide sufficient notice and exit the contract, Grand24 reserves the right to withhold payment for the preceding period and to pause your account.
8. Contractual Obligations
8.1 By using the Grand24 platform service you agree to use the service for all current and future work that takes place as a result of an introduction made through the Grand24 platform. You must not create contractual agreements outside this service with carers introduced to you on the Grand24 platform, with the deliberate intention of avoiding Grand24 fees. Any offences will result in but are not limited to the immediate termination of a care seeker’s and carer’s profile.
9.User Conduct and Disputes
9.1 Any agreements are legally binding agreements between the Care Seeker and the Carer. We, Grand24, are not the party to an agreement and we cannot arbitrate or mediate if there is an alleged breach of contract. Any issues should be resolved directly between care seeker and carer where at all possible. Grand24 does not accept any liability for claims, demands, or direct or indirect damages arising from disputes between care seekers and carers.
9.2 If a concern or complaint is raised with us, it is at our absolute discretion what action, if any, we decide to take. Any action we take will be in line with our Concerns, Complaints, and Abuse Procedures outlined in our guidelines to Users and determined by the nature of each dispute. We reserve the right to immediately notify an appropriate authority or regulator in order to protect the interests of our Users and you accept that this overrides any confidentiality obligations, whether express or implied, we have to you. We also reserve the right to immediately remove any carer from the platform whilst we investigate any complaint or allegation. We also reserve the right to inform other care seekers if an allegation, complaint, or investigation pertaining to their carer is occurring or ongoing.
10. Grand24’s Liability
10.1 Responsibility for Contract Acceptance
You acknowledge that the decision to enter into a contract with a care seeker is your sole responsibility and that Grand24 gives no warranty as to the suitability of any work assignment you accept, nor does Grand24 provide any warranty as to the character or history or honesty of any care seeker or the truthfulness or accuracy of information or documentation provided by the care seeker. Grand24 endeavours to screen and risk assess every client that uses the platform to ensure a safe and positive community for all participants. However, Grand24 does encourage you to make Grand24 aware of concerning the client’s behaviour. Grand24 reserves the right to take any action to safeguard carers working via the platform.
10.2 Platform Constraints
The Platform is used at the Carer’s own risk and Grand24 does not guarantee that the Platform will operate optimally and with 100 percent up-time, or not be temporarily or permanently suspended. Grand24 shall not be liable for losses or damages caused by the unavailability of the service, technical errors, or usage of the platform outside of the intended purpose. Grand24 is not liable for controversies, losses, claims, or any damages arising out of the usage of the platform.
10.3 Risk of Introduction Service
You agree that you understand the risks involved in participating in an introductory agency service and you hereby waive any rights to claims for damages from Grand24 in relation to the service.
10.4 Breach of Terms and Conditions
You agree to indemnify and not to hold Grand24 responsible or make any claim or demand brought against Grand24 as a result of you breaching these terms and conditions.
11. Liability Cap
11.1 You acknowledge that where you agree to provide Care or to engage a care seeker to provide Care; this is an agreement between you and the care seeker and we shall not be a party to that agreement or have any liability in relation to it.
11.2 You shall not involve us in any proceedings or other disputes between you and the care seeker and you agree to indemnify us and hold us harmless against any loss, damage, or costs we incur as a result of becoming involved in any dispute between you and the care seeker.
11.3 Grand24 shall not be liable for loss of profits; or loss of business; or depletion of goodwill and/or similar losses; or loss of anticipated savings; or loss of goods; or loss of contract; or loss of use; or corruption of data or information; or any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses.
11.4 Nothing in these Terms shall limit or exclude in any way our liability for:
11.4.1 death or personal injury caused by its negligence;
11.4.2 fraud or fraudulent misrepresentation; or
11.4.3 any other liability that may not, under applicable law, be excluded or limited.
11.5 You acknowledge that Grand24’s total liability to you whether in respect of goods or services and whether based in negligence, breach of contract, misrepresentation or otherwise shall not exceed the value of the total commission income Grand24 derived from you via the Grand 24 platform service for a maximum period of one year.
12. Privacy Statement
12.1 By using the Grand24 services you consent that Grand24 may process the personal data that Grand24 collects from you in accordance with Grand24’s Privacy Policy.
13. Intellectual Property Rights and Confidentiality
13.1 All information, data and materials presented on this website, including names, photographs and other images, logos, etc., are owned by Grand24 and are subject to copyright, trademark rights, database rights and/or other intellectual property rights. You acknowledge that you do not acquire any ownership rights in any of our intellectual property by accessing or downloading content from the platform.
13.2 You agree to keep strictly confidential at all times any information you receive in any medium or format about potential, existing and past clients from either Grand24 or the clients themselves. This includes but is not limited to personal information and medical information.
14. Governing Law
14.1 The terms and conditions and any dispute arising out of the site and/or the services shall be governed by and construed in accordance with the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with the agreement or in connection with this platform or service.
